The EU Settlement Scheme enables citizens from the EU, Switzerland, Norway, Iceland or Liechtenstein to continue living in the UK following the UK’s departure from the EU on 31 January 2020.
EU, Switzerland, Norway, Iceland and Liechtenstein citizens who were living in the UK by 31 December 2020 and their eligible family members can apply to the EU Settlement Scheme should they wish to continue living in the UK beyond the end of the ‘grace period’ (30 June 2021).
Applicants who are eligible under the EU Settlement Scheme but have not been in the UK for 5 years meeting the definition of ‘continuous qualifying period’ under the Immigration Rules, can apply for ‘pre-settled’ status. Under pre-settled status applicants will be granted 5 years limited leave.
If an applicant spends more than 2 years continuously outside the UK, they will lose their pre-settled status.
The deadline to apply under the scheme was 30 June 2021, however there is provision to make an application after the deadline in specific cases where the Home Office considers there are 'reasonable grounds' for missing the deadline.
Family members can also make an application.
Once an applicant has been in the UK for 5 years and meets the definition of ‘continuous qualifying period’ under the Immigration Rules, they will be eligible to apply for settled status.
There is no fee to pay for an application under the EU Settlement Scheme.
Applicants are not required to pay the Immigration Health Surcharge.
